2. Product Descriptions and Appearance

We have made every effort to display as accurately as possible the colors, textures, and images of our products that appear at the store. However, because our sweets are handmade and traditional, the actual product you receive may vary slightly in color, shape, or weight from the photographs on our website.

3. Allergen and Health Disclaimer

Important: Our products are prepared in a traditional Indian sweet-making facility. Our products contain or may come into contact with common allergens, including but not limited to milk/dairy (ghee, mawa), wheat, tree nuts (almonds, cashews, pistachios), and edible food colors. By purchasing our products, you acknowledge that it is your responsibility to check the ingredients if you have food allergies. Ghanshyam Penda Wala will not be held liable for any allergic reactions or health issues resulting from the consumption of our products.

4. Perishability, Shelf Life & Storage

Our pendas and traditional sweets are fresh, perishable food items made without artificial commercial preservatives.

Customers are responsible for reading any storage instructions provided on the packaging or website.

Once delivered, sweets must be stored appropriately (e.g., in a cool, dry place or refrigerated) and consumed within the stated shelf life. We are not responsible for products that spoil due to improper storage by the customer after delivery.

5. Pricing and Billing

Prices for our products are subject to change without notice. All prices listed on the website are in Indian Rupees (INR) and are inclusive of GST unless otherwise noted. We reserve the right at any time to modify or discontinue a product without notice. We shall not be liable to you or to any third-party for any modification, price change, or discontinuance.

6. Accuracy of Billing and Delivery Information

You agree to provide current, complete, and accurate purchase and shipping information for all purchases made at our store. Failed Deliveries: Because our items are highly perishable, if a courier is unable to deliver your package because you provided an incorrect address, an incorrect phone number, or because no one was present to accept the delivery, Ghanshyam Penda Wala will not be held responsible for the spoiled food, and no refunds will be issued. Any extra cost incurred for redelivery (if possible) shall be claimed from you.

7. Returns and Refunds

Because we sell perishable food items, returns and refunds are strictly governed by our Return & Refund Policy. By agreeing to these Terms of Service, you also agree to our Return & Refund Policy.

8. Third-Party Tools & Links

We may provide you with access to third-party tools (such as payment gateways like Razorpay, PayU, or Shopify Payments) over which we neither monitor nor have any control nor input. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

9. Governing Law and Jurisdiction

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India. Any legal disputes or claims arising out of your purchase or use of our website shall be subject to the exclusive jurisdiction of the courts located in Rajkot, Gujarat.
